1 Acceptance of Terms

Welcome to FreeLoveNation (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Member,” or “you”) and FreeLoveNation, Inc., governing your access to and use of the FreeLoveNation website located at www.freelovenation.com, our mobile applications, and all associated services (collectively, the “Platform” or “Service”).

By creating an account, clicking “I Agree,” accessing, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2 Eligibility

To use FreeLoveNation, you must meet all of the following eligibility requirements:

• You must be at least 18 years of age. FreeLoveNation is strictly an adult platform and does not permit minors to register or use any feature of the Service.
• You must be legally permitted to enter into a binding contract under applicable law.
• You must not have been previously suspended, banned, or removed from FreeLoveNation or any affiliated service for violations of our policies.
• You must not be prohibited by law from receiving or using the services offered through the Platform.
• You must not be a convicted sex offender or included on any government-maintained sex offender registry.

We reserve the right to request verification of your age or identity at any time. If we have reason to believe you do not meet these requirements, we may suspend or permanently terminate your account without prior notice or liability.

Geographic Restrictions

The Service is intended for use in jurisdictions where online dating services are permitted by law. It is your responsibility to ensure that accessing FreeLoveNation is legal in your jurisdiction. We reserve the right to restrict access in certain regions at our discretion.

3 Account Registration & Security

To access most features of FreeLoveNation, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information in all required fields.
• Use your real identity and not impersonate any person or entity.
• Create only one (1) account per person. Multiple accounts are prohibited.
• Maintain and promptly update your registration information to keep it accurate.
• Keep your password secure and confidential at all times.
• Immediately notify us at security@freelovenation.com if you suspect unauthorized use of your account.

Account Security

You are solely responsible for all activity occurring under your account. FreeLoveNation will not be liable for any loss or damage arising from your failure to maintain account security. We strongly recommend enabling two-factor authentication (2FA) and using a unique, strong password.

Account Verification

FreeLoveNation offers optional profile verification (photo ID, selfie verification, and/or phone verification) to enhance trust and safety within the community. While verification is encouraged, it does not constitute an endorsement or guarantee of any member’s identity, character, or intent. Verified status may be revoked if discrepancies are found.

4 User Conduct & Prohibited Activities

FreeLoveNation is committed to maintaining a safe, respectful, and authentic community. By using our Platform, you agree not to engage in any of the following prohibited activities:

4.1 Identity & Misrepresentation

• Using false identities, fake photos, or misleading profile information.
• Impersonating any real person, celebrity, or public figure.
• Creating profiles on behalf of another person without explicit consent.
• Using AI-generated images as your profile photo.

4.2 Harmful & Illegal Content

• Posting, uploading, or distributing any content that is obscene, defamatory, threatening, harassing, abusive, hateful, or discriminatory.
• Sharing any sexually explicit content depicting minors (CSAM). Violations will be immediately reported to NCMEC and law enforcement.
• Uploading content that infringes on the intellectual property rights of any third party.
• Transmitting spam, chain letters, pyramid schemes, or unsolicited mass communications.

4.3 Commercial & Fraudulent Activity

• Soliciting money, gifts, or financial assistance from other members in any form.
• Promoting or advertising any products, services, or third-party websites.
• Engaging in any form of romance scam, fraud, or deceptive financial scheme.
• Selling or transferring your account to any other person.

4.4 Platform Abuse

• Using bots, scrapers, automated scripts, or other unauthorized tools to access or extract data from the Platform.
• Attempting to gain unauthorized access to any part of the Platform or its backend systems.
• Interfering with or disrupting the Platform’s infrastructure, servers, or networks.
• Circumventing subscription restrictions or accessing premium features without payment.
• Reverse engineering, decompiling, or disassembling any part of the Service.

5 User Content

5.1 Your Content

FreeLoveNation allows you to post, upload, and share photos, videos, text, and other materials (“User Content”) on your profile and within the Platform. You retain ownership of all User Content you submit.

5.2 License to FreeLoveNation

By submitting User Content to the Platform, you grant FreeLoveNation a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in connection with operating and improving the Service, including for promotional and marketing purposes on any media.

5.3 Content Standards

All User Content must comply with our Community Guidelines. You represent and warrant that:

• You own or have the necessary rights to submit the content.
• The content does not violate any law or infringe any third party’s rights.
• The content is accurate and not misleading.
• Photos depict only yourself (for profile photos) or content you are authorized to share.

5.4 Content Moderation

We reserve the right to review, screen, edit, refuse, or remove any User Content at our sole discretion, at any time and without notice, for any reason, including violation of these Terms or Community Guidelines. We do not guarantee that all content will be reviewed prior to publication.

6 Subscriptions & Billing

6.1 Free & Premium Tiers

FreeLoveNation offers both free and paid subscription tiers. Free members enjoy basic access, including browsing profiles, receiving matches, and limited messaging. Premium subscriptions (“Plus,” “Gold,” or “Platinum”) unlock additional features including unlimited messaging, advanced filters, read receipts, profile boosts, and more.

6.2 Subscription Terms

• Premium subscriptions are billed on a recurring basis (monthly, quarterly, or annual) as selected at checkout.
• Your subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
• Prices are stated in USD and are subject to applicable taxes.
• We reserve the right to modify pricing with at least 30 days’ notice to current subscribers.

6.3 Payment Processing

We accept payment through multiple processors including Stripe, CCBill, Segpay, NetBilling, Epoch, and others as displayed at checkout. By providing payment information, you authorize us to charge your selected payment method for the applicable subscription fee. All transactions are encrypted and processed securely.

6.4 Virtual Currency & Credits

FreeLoveNation may offer virtual coins, credits, or boosts that can be purchased separately. These have no monetary value outside the Platform, cannot be transferred between accounts, and expire upon account termination. All virtual currency purchases are final.

7 Refund Policy

7.1 General Policy

All subscription fees are non-refundable, except where required by applicable law. If you cancel your subscription, you retain access to premium features until the end of your current billing period, after which your account reverts to the free tier. We do not provide pro-rated refunds for partial periods.

7.2 Exceptions

We may issue refunds in the following limited circumstances, at our sole discretion:

• Duplicate charges due to technical error.
• Unauthorized charges not made by you, subject to verification.
• Platform unavailability exceeding 72 consecutive hours due to our fault.
• Jurisdictions where consumer protection laws require refund rights (e.g., EU 14-day right of withdrawal).

7.3 Chargebacks

If you initiate a chargeback for a charge you authorized, your account will be immediately suspended pending investigation. Fraudulent chargebacks may result in permanent account termination and may be reported to credit agencies.

To request a refund or dispute a charge, contact billing@freelovenation.com within 30 days of the charge date.

8 Privacy

Your privacy is extremely important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FreeLoveNation, you consent to the data practices described in our Privacy Policy.

Key privacy highlights include:

• We collect profile information, usage data, location (with consent), and communication data to provide and improve the Service.
• We do not sell your personal information to third-party advertisers.
• You may request deletion of your personal data at any time through Settings or by emailing privacy@freelovenation.com.
• We comply with GDPR, CCPA, and other applicable privacy regulations.

9 Intellectual Property

9.1 Our Property

The FreeLoveNation Platform, including its name, logo, design, features, software, text, graphics, and the arrangement thereof, is owned exclusively by FreeLoveNation, Inc. and is protected by copyright, trademark, trade secret, and other intellectual property laws. All rights not expressly granted are reserved.

9.2 Trademarks

“FreeLoveNation,” the FreeLoveNation logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FreeLoveNation, Inc. You may not use such marks without our prior written permission.

9.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes, strictly in accordance with these Terms. This license does not include the right to copy, distribute, modify, create derivative works, or commercially exploit any part of the Platform.

9.4 Copyright Infringement (DMCA)

If you believe your copyrighted work has been infringed on our Platform, please send a DMCA takedown notice to our designated agent at dmca@freelovenation.com with the information required under 17 U.S.C. § 512(c)(3).

10 Third-Party Services

The Platform may contain links to or integrations with third-party websites, services, or applications (including payment processors, social login providers, and analytics tools). These third-party services have their own terms and privacy policies. FreeLoveNation is not responsible for the content, practices, or policies of any third party. Your use of third-party services is at your own risk.

Payment processors (including but not limited to Stripe, CCBill, Segpay, Epoch, NetBilling, and Verotel) handle payment card data independently according to PCI DSS standards. FreeLoveNation does not store your full payment card information.

11 Disclaimers & Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FREELOVENATION DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Any warranty that the Platform will meet your requirements or be available on an uninterrupted, timely, secure, or error-free basis.
• Any warranty regarding the quality, accuracy, or reliability of any content or information obtained through the Platform.
• Any warranty that results obtained from use of the Platform will be accurate or reliable.
• Any warranty regarding the conduct or character of other users.

Background Checks: FreeLoveNation does not conduct criminal background checks on members. We strongly encourage you to exercise caution, follow our Safety Guidelines, and meet first dates in public places. We are not responsible for the actions of any member.

12 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FREELOVENATION, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, punitive, or exemplary damages.
• Loss of profits, revenue, data, business opportunities, or goodwill.
• The conduct or content of any third party or other user on the Platform.
• Any unauthorized access to or alteration of your transmissions or data.
• Damages arising from your reliance on information obtained through the Platform.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO FREELOVENATION IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

Some jurisdictions do not allow limitation of liability for certain damages; in such cases, our liability will be limited to the fullest extent permitted by law.

13 Indemnification

You agree to indemnify, defend, and hold harmless FreeLoveNation, Inc., its subsidiaries, affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to:

• Your use of or access to the Platform.
• Your violation of these Terms.
• Your violation of any third-party right, including intellectual property, privacy, or publicity rights.
• Any User Content you submit to the Platform.
• Your interaction with any other user, including offline meetings arranged through the Platform.

We reserve the right, at our own expense, to assume exclusive defense of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

14 Dispute Resolution & Arbitration

14.1 Informal Resolution

Before initiating any formal dispute, you agree to first contact us at legal@freelovenation.com and attempt to resolve the dispute informally for at least 30 days. Many disputes can be resolved this way quickly and without formal process.

14.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English in the State of Delaware.

14.3 Class Action Waiver

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. All disputes must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.

14.4 Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For matters exempt from arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.

14.5 Exception for Injunctive Relief

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or to prevent irreparable harm.

15 Termination

15.1 Your Right to Terminate

You may delete your account at any time through Settings → Account → Delete Account, or by emailing support@freelovenation.com. Upon deletion, your profile and personal data will be removed from public view. Certain data may be retained as required by law or for fraud prevention purposes.

15.2 Our Right to Terminate

We may suspend or permanently terminate your account at our sole discretion, with or without notice, if we believe you have violated these Terms, our Community Guidelines, or applicable law, or if continued operation of your account poses a safety risk to other users or the integrity of the Platform.

15.3 Effect of Termination

Upon termination, your license to use the Platform immediately ceases. We may delete your account data. Any outstanding subscription fees will not be refunded. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability, indemnification, and dispute resolution) shall survive.

16 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting a notice on the Platform.
• Sending an email to your registered email address.
• Displaying an in-app notification requiring your acknowledgment.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.

We encourage you to review these Terms periodically. The date of the most recent revision is displayed at the top of this page.
